Qualifications

education and experience: Two years of college coursework and four years of experience in criminal justice or a related field, including a minimum of two years’ experience with disposition of firearms or criminal justice qualifying information.

Substitution of Experience for Education: Qualifying full-time professional experience in criminal justice or a related field may be substituted for the required education on a year for year basis to a maximum of two years.

Necessary Special Qualifications:

  1. Must be a citizen of the United States.
  2. Supply a fingerprint sample in a manner prescribed by the TBI for a fingerprint based criminal history records check;
  3. Complete a criminal history and background disclosure form in a manner approved by the appointing authority and agree to release all records involving any criminal history or necessary records to the appointing authority;
  4. Be subject to an intense background investigation in a manner prescribed by the appointing authority, which includes but not limited to a check of State and Federal criminal records, driving history, social media accounts, credit check, education, military, previous employment, drug use, and reference verification.

Overview

This classification reviews and analyzes criminal records and supporting documents to determine if there are prohibiting factors that prevent potential gun buyers from purchasing firearms. This job class performs more complex examination of legal instruments and supporting documents to determine whether a requested action complies with certain provisions of various state and federal laws pertaining to the disposition of firearms. This classification performs responsibilities at the advanced working level under the guidance of a supervisor. This series has associate and intermediate levels that function at an entry to working level capacity. This series has an expert level that functions at a more complex capacity.

*An applicant appointed to this Career Path series may be promoted to a(n) Legal Instrument Examiner-Expert after meeting all required qualifications of the Expert level and completing a full performance cycle that awards the rating of `exceeds expectations’ or higher.

Responsibilities

  1. Receives telephonic and electronic inquiries and performs Personal Identifying Information (PII) (e.g., name, date of birth, etc.) searches of federal and state databases via the Tennessee Instant Check System (TICS) flex check system.
  2. Reviews daily firearms transaction denials to ensure accuracy. Addresses errors and inaccuracies on denials with unit team members.
  3. Trains new team members on TICS policies and procedures.
  4. Assists Associate and Intermediate level team members to ensure competency in comprehending and retrieving criminal histories (e.g., obtaining Tennessee and other state information from law enforcement databases).
  5. Processes appeals by requesting arrest records, court judgments, and/or drug test results from criminal justice entities for denied transactions. Reviews responses from requested agencies to determine if an individual is prohibited from owning or possessing a firearm. Communicates final determination.
  6. Updates state database with final disposition and provides supporting documentation to out of state and federal firearm repositories to update criminal histories. Identifies federally disqualified individuals with Identification for Firearms Sales (IFFS) flags to indicate a prohibited record.
  7. Communicates with law enforcement agencies on National Instant Check System (NICS) and National Crime Information Center (NCIC) disqualifiers (e.g., fugitives, orders of protection, identified adjudicated mental defective, stolen firearms, etc.)
  8. Serves as a liaison between TICS and Alcohol Tobacco and Firearms (ATF), Federal Bureau of Investigation (FBI/NICS), and local and state law enforcement agencies.
