The AC2 represents the public interest in ratemaking matters before PUC Administrative law Judges by analyzing written documents such as rate filings, interrogatories and testimony, coordinating a team of technical staff, and preparing briefs, memoranda, and relevant correspondence. Specifically, the AC2 will:

- Coordinate a team of technical staff, and prepare briefs, memoranda, and relevant correspondence.
- Develop a prosecutory strategy for discovery, testimony, cross-examination, and settlement negotiations as a lead attorney in rate filings under one million dollars and under the guidance of a senior attorney in rate filings over one million dollars.
- Prepare research, analyses, and recommendations on a variety of issues involving formal and informal investigations, administrative procedures, evidence, and trial practice.
- Work independently or with co-counsel to evaluate the relative merits of legal positions and to subsequently prepare data requests and negotiate settlement agreements, or, if proceeding to litigation, prepare interrogatories, present witnesses and exhibits, cross-examine witnesses and analyze evidence, litigate before PUC Administrative Law Judges.
- Prepare and file motions, briefs, exceptions, and other pleadings as necessary for the prosecution of cases.
Essential Functions
1. Ability to read and effectively analyze written documents such as rate filings, interrogatories, testimony, briefs, Public Utility Commission and Court decisions, petitions and general correspondence, and determine the proper Investigation and Enforcement response.
2. Ability to coordinate actions in prosecutions under the guidance of a senior attorney in rate filings over one million dollars, and as lead attorney in rate filings under one million dollars.
3. Ability to coordinate actions/prosecutions for assigned complaints.
4. Ability to coordinate a prosecutory team consisting of technical and legal staff.
5. Ability to develop a coordinated prosecutory strategy of discovery, direct examination, cross examination and settlement negotiations.
6. Ability to travel to hearings, discovery conferences and public input hearing located away from the primary work site.
7. Ability to communicate verbally with staff of the Bureau of Investigation and Enforcement, utility personnel, counsel for intervening parties, administrative law judges and witnesses in formal proceedings.
8. Ability to effectively prepare briefs, reply briefs, exceptions, reply exceptions, petitions and answers to petitions, as well as any other correspondence and documentation.
9. Regular attendance at your headquartered worksite or any assigned work location.
Work Schedule and Additional Information:
- Full-time employment.
- Work hours are 8:00 a.m. to 4:30 p.m. with a 60-minute lunch. Monday through Friday.
- Telework: This position is headquartered in Harrisburg. Part-time telework is a potential feature of this position. Successful candidates are required to report to the headquarters worksite daily, unless the employee meets eligibility requirements and telework has been approved by the Bureau Director.
- To be eligible to participate in telework, the employee’s Alternate (telework) Worksite must meet the following requirements. The telework worksite must be located: 1) within a reasonable travel distance of headquarters, and 2) within the Commonwealth of Pennsylvania.

- REQUIRED experience, TRAINING & ELIGIBILITY

- Two years of progressively responsible experience in professional legal work which provided exposure to governmental regulatory law (regarding public utilities)/administrative law and graduation from an approved school of law
- Any equivalent combination of experience and training.
Necessary Special Requirements
- Possession of a certificate of admission to the Bar of the Supreme Court of Pennsylvania; or
- Eligibility for a certificate of admission to the Bar of the Supreme Court of Pennsylvania; or
- Possession of a certificate of admission to the bar of the highest court of another state, with preparatory steps taken to become a member of the Bar of the Supreme Court of Pennsylvania.
